Welcome to PlantSonics. These Terms & Conditions are the agreement between you and JEvolve LLC, the company that operates the PlantSonics website and sells PlantSonics devices manufactured by others. By using this website, placing an order, or buying a product from us, you agree to these terms. If you don’t agree, please don’t use the site or make a purchase.

We’ve tried to write these in plain English. Anything that needs more detail is covered in our Privacy Policy, Shipping Policy, and Return Policy — each linked from the footer of every page.

Who Can Buy

You must be at least 18 years old to make a purchase from PlantSonics. By placing an order, you confirm that you are 18 or older and that the information you provide is accurate.

Products and Pricing

We sell PlantSonics plant music devices and related accessories. We do our best to describe each product accurately, but we cannot guarantee that every detail (including images, colors, specifications, and packaging) will be perfect or current at all times. Products may differ slightly from photos due to lighting, screen settings, or running design changes.

All prices are listed in US dollars and may change at any time. Sales tax will be added at checkout where required. If we discover a pricing or product description error after you place an order — for example, an obvious mispricing — we’ll contact you, give you the option to cancel for a full refund, and proceed only if you agree to the corrected price.

Orders

Placing an order is an offer to buy. We accept your offer when we send you a confirmation email and charge your payment method. We reserve the right to refuse or cancel any order at our discretion — for example, if a product is out of stock, if we suspect fraud, or if there’s a pricing error.

If we cancel an order before shipping, we’ll refund the full purchase price. If we’ve already charged your payment method, the refund will go back to the original payment method.

Payment

We accept credit and debit cards through Stripe, plus Klarna for installment payments and PayPal where available. Payment processors handle your payment information directly — we don’t store credit card numbers on our website. By placing an order, you authorize us (and the relevant payment processor) to charge your selected payment method for the full order amount including any applicable taxes and shipping.

Shipping

Shipping terms, processing times, delivery estimates, and how we handle lost, delayed, or damaged shipments are covered in our Shipping Policy. Risk of loss passes to you when the carrier takes possession of the package, except where addressed otherwise in the Shipping Policy.

Returns and Warranty

Our 30-day return window, one-year manufacturer’s warranty, and the process for returns and warranty claims are covered in our Return Policy. By making a purchase, you agree to those terms.

Our Content

Everything on the PlantSonics website — the PlantSonics name, logo, product names, photographs, illustrations, videos, audio recordings, written copy, and overall site design — is owned by JEvolve LLC or used with permission. You may not copy, reproduce, modify, distribute, or use any of it for commercial purposes without our written consent.

You’re welcome to share links to our pages, post photos of your device on social media, and tell people about us. That’s appreciated, not prohibited.

How You Use the Site

When using our website, you agree not to:

Use the site for any unlawful purpose, or to facilitate any unlawful activity.
Attempt to gain unauthorized access to our systems, other customers’ accounts, or any non-public area of the site.
Scrape, copy, or systematically extract content from the site.
Introduce viruses, malware, or any other malicious code.
Submit fraudulent orders or use stolen payment methods.
Harass, threaten, or impersonate others when communicating with us.

Website Disclaimer

We provide the PlantSonics website on an “as is” basis. We do our best to keep it accurate and available, but we don’t guarantee that the site will always be free of errors, interruptions, or technical issues. Information on the site — including blog posts, scientific references, and educational content — is provided for general information and is not professional, medical, or legal advice.

This disclaimer applies to the website itself. The PlantSonics devices you purchase are covered by the respective one-year manufacturer’s warranty, as described in the Return Policy.

Limitation of Liability

To the fullest extent permitted by law, JEvolve LLC and PlantSonics will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website or any product purchased from us. Our total liability for any claim arising from or related to a product or your use of the site will not exceed the amount you paid for the product in question.

Some states do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless JEvolve LLC and its owners, employees, and partners from any claim, loss, or expense (including reasonable attorney’s fees) arising from your violation of these Terms, your misuse of the website, or your violation of any law or third party’s rights.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or your use of the site will be resolved in the state or federal courts located in Palm Beach County, Florida, and you consent to that jurisdiction.

Resolving Disputes

If you have a problem, please email info@plantsonics.com first. We’re a small US-based team and we’d rather work things out directly than escalate. Most issues can be resolved with a quick conversation.

Changes to These Terms

We may update these Terms from time to time. When we do, we’ll change the “Last updated” date at the top of the page. Continued use of the site after a change means you accept the updated Terms. For material changes, we’ll post a notice on the website.
